Terms of Service

Who are we?
We are Blaze Payments, Inc., a Delaware corporation ("Parent" or "Blaze"), and its subsidiaries and affiliates, including, but not limited to, Blaze Payments, SP. Z O.O., a private limited company based in Poland that is a wholly owned subsidiary of Parent (all individually and collectively referred to as "we", "us", "our" in these Terms of Service ("Terms")).
Blaze is not a bank, custodian, or account provider. Any and all Services and Apps referenced herein are supported by financial institutions, including banks and money service businesses, for the provision of any financial service or services supported (see Financial Services Partners defined below). Users are not provided accounts, custody products, or financial services by Blaze, though Users may, depending on the products they access in the Blaze Services and App, become direct customers to the various Financial Services Partners that support the Blaze Services and App.
When do these terms apply?
These Terms apply to all users ("Users") who access or use our websites, computer and mobile software applications ("App" or "Apps"), mobile sites, resources, and other products or technology ("Service" or "Services"). Third party recipients of assets through any Service are also regarded as Users. If you are not eligible to use the Services according to the terms listed herein or in our other policies or under applicable law or you do not agree to the Terms, then you are not permitted to use the Services. By using the Services, you agree to all of the terms contained within these Terms and the other policies linked in these Terms.
Eligibility and Limitations
The Service is not available in all regions or to all customers. Terms, conditions, limitations, and restrictions apply.
You must be at least 18 years old to use the Service. By agreeing to these Terms, you represent and warrant to us that:
- you are at least 18 years old,
- you have not previously been suspended or removed from the Service,
- your registration and your use of the Service is in compliance with any and all applicable laws and regulations,
- you have not accessed and will not access, use, and or otherwise receive the Service in any region or on behalf of any person or persons where or for whom the Service is illegal, impermissible, and or otherwise prohibited by applicable laws and regulations;
- all references to "you" throughout these Terms will include that person or entity.
The Service is intended only for use within jurisdictions where such use would comply with all applicable laws, rules, and regulations. You may not use or access the Service in, or otherwise with respect to, any location or jurisdiction where it is prohibited by applicable laws, rules, and regulations. We make no representation that the Service is appropriate or available for use in any specific jurisdiction or location. Access to the Services from countries or territories or by individuals where such access is illegal, impermissible, and or otherwise prohibited by applicable laws and regulations is expressly prohibited.
Privacy
For information about how we collect, use, share or otherwise process information about you, please see our Privacy Policy. By using any of the Services, you agree to be bound by the terms of the Privacy Policy.
Product and Technology
We have built a technology layer empowering you to send money around the world in accordance with applicable law, by leveraging blockchain infrastructure and stablecoins, such as USDC. This enables you to exchange your fiat money for virtual currency and transfer your virtual currency to other Users or recipients facilitated by participating Financial Services Partners.
Blaze provides technology solutions to help Users create their own secure self-custody wallet. Blaze is not a custodian and Blaze does not control your wallet or facilitate the funding of any deposits or balances in your wallet.
Through our Financial Services Partners, Blaze's technology provides you the tools for your exchange of supported fiat for supported virtual currency.
Through these partners, Blaze's technology enables you to self-host supported virtual currencies.
Users maintain control of their wallets and virtual currencies through Blaze's technology, as they own and possess the funds with Blaze's partners, and in the wallets Blaze's technology assisted in creating.
User Accounts and Account Security
You need to register for a User account within our own technological portal to access some or all of our Services ("Account"). Please note, Blaze is not a bank and assets Users keep in their personal Blaze wallet are not FDIC insured. "Account" does not mean a consumer finance or bank account—rather it refers only to a User's unique login credentials for Blaze technology. If you register for an Account, you must provide accurate Account information and promptly update this information if it changes. Blaze and certain Blaze Financial Services Partners may require Users to submit certain "Know Your Customer" and screening information ("KYC Details"). Your KYC Details may be used and stored as necessary to perform the required anti-money laundering, anti-fraud and other applicable financial crimes screening and prevention. KYC Details may include inquiries, including inquiries through third parties, necessary to verify your identity and use of the Blaze Services. Blaze, and Blaze Financial Services Partners may take responsive action based on the results of such inquiries.
You also must maintain the security of your Account and promptly notify us if you discover or suspect that someone has accessed your Account without your permission. You may not permit others to use your Account credentials, you are solely responsible for the activities of such Users that occur in connection with your Account. We reserve the right to reclaim usernames, including on behalf of businesses or individuals that hold legal claim, including trademark rights, in those usernames.
User KYC Details may be screened and monitored by Blaze or Blaze Financial Services Partners on an ongoing basis. Blaze reserves the right, at any time, to suspend an Account or a User's access to Blaze technology and Services based on adverse screening results and or based on a notification or request from a Blaze Financial Services Partner.
Account Termination
You may close your Account after all assets associated with your Account have reached a balance of zero, removing all Blaze Apps from your device, and emailing legal@blaze.money your request to close the Account. Once Blaze confirms the Account has been closed, then the Terms between you and Blaze will terminate (other than those provisions that by their nature would or should survive termination.)
Payment Terms
You are responsible for all transactions made under your Account. You authorize Blaze to communicate with Financial Services Partners regarding transactions you initiate in your Account. You are also responsible for the applicable fees for your use of the Service whether charged by Blaze or Blaze Financial Services Partners. If you are late or fail to make payment, Blaze may take steps such as suspending your Account or charging additional fees.
Authorization
You authorize Blaze to charge all sums for the transactions that you make and any level of Service you select as described in these Terms or in-App, including any fees charged by our partners and all applicable taxes, to the payment method specified in your Account.
Unpaid Fees
Blaze may suspend access to the Service for any Account for which any amount is due but unpaid. In addition to the amount due for the Service, you may incur additional fees for any chargeback or collection of any of the unpaid amount, including collection fees.
Invalid Authorization
If a transaction you initiate is invalidated because the originating bank declined or reversed the transaction, then you may be liable, for the transaction at the sole discretion of Blaze's Financial Services Partners. This decision may result in losses based on the value of exchanged fiat or digital currencies and you acknowledge and agree that We have no liability of any kind for such losses.
Unauthorized Transactions
If you believe that a transaction initiated on your Account was not authorized, then you must notify us immediately by emailing support@blaze.money, so that we may inform our Financial Services Partners. If you fail to report the unauthorized activity directly to us, you may be liable as described above. Certain transactions may be subject to the policies and disclosed limitations applicable to Blaze's Financial Services Partners' customer accounts and services, including customer liability for unauthorized transactions.
Transaction Fees
Blaze charges transaction fees as fully disclosed at www.blaze.money.
Transaction Limits
Due to restrictions from our Financial Services Partners, our Services currently support transactions up to the limits listed below. These limits apply to all types of transactions, including ACH transfers and debit card transfers, however they exclude credit card payments. Please be aware that we or our Financial Services Partners may change these limits periodically based on regulatory needs and limitations, or business needs and limitations. Blaze will use commercially reasonable efforts to notify you of the new limits.
Bank Transfer Limits
Transferring Money to Blaze's Financial Services Partners
- Bank Transfers: You can use the Blaze app to add assets up to $10,000 from your bank to your Account with our Financial Services Partners.
- Debit Card Transfers: You can use the Blaze app to add up to $2,000 per week to your Account with our Financial Services Partners, from a debit card.
- Additional Declines: Transfers can be declined for reasons beyond the specified limits.
Transferring Money from Blaze's Financial Services Partners to a Bank Account
- Bank Transfers: You can use the Blaze app to transfer up to $19,999.99 per week from your Account with our Financial Services Partners to your bank account.
- Per Transfer Limit: There is a $5,000 limit per transfer. To transfer more than $5,000, you will need to initiate multiple transfers.
- Additional Declines: Transfers can be declined for reasons beyond the specified limits.
Weekly Rolling Limits
Unless otherwise specified in these Terms, transaction limits are based on a rolling weekly period. This means that each transaction counts against your limit for exactly one week (or seven (7) days) from the time of authorization, on a cumulative rolling basis with all authorized transactions. For instance, if you initiate a bank transfer on Monday at 11:00 AM, it will count against your limit until the following Monday at 11:01 AM.
Limit Reviews and Adjustments
Limits are periodically reviewed and may be adjusted based on your transaction history, activity, and other factors. Blaze reserves the right to apply and modify limits at its sole discretion.
Account Statements
Blaze will provide and you have the right to view statements detailing your transactions and activity ("Statements"). You may access these Statements by logging into your Blaze Account.
Taxes and Information Reporting
You are solely responsible for collecting, assessing, reporting, and remitting the correct taxes to the appropriate authorities. Blaze may and will, where required by applicable law, provide certain transaction and other reports to state, federal, and international tax authorities.
Our fees do not include any taxes, levies, duties, or similar governmental assessments of any nature, such as income tax, value-added tax, sales tax, use tax, or withholding taxes, imposed by any jurisdiction (collectively, "Taxes"). It is your responsibility to determine what taxes apply to the payments you make or receive and to assess, collect, report, and remit the correct taxes to the appropriate authority. Blaze is not responsible for determining the applicability of taxes to your transactions, nor for calculating, collecting, reporting, or remitting taxes arising from any transaction. You acknowledge that Blaze may report certain transactions to state, federal, and international tax authorities as deemed necessary or advisable by Blaze, in its sole discretion.
Taxpayer Identification Number and Withholding Tax
We may request your social security number, national tax identification number, and/or a US tax form such as W-9 or W-8. Failure to provide the requested information and documentation may result in Account limitations and the imposition of federal and state withholding taxes on all US source income payments received, as well as other local withholding taxes where applicable.
Prohibited Conduct
You agree not to violate any applicable law, contract, intellectual property right or other third-party right or violate any applicable law, rule or regulation in connection with your use of the Services. You agree that you are solely responsible for your conduct while using the Services. You further agree not to do any of the following in connection with your use of the Services:
- Engage in any unlawful activity which would violate, or assist in violation of, any law, statute, ordinance, regulation, or sanctions programs administered in the countries where Blaze conducts business, including but not limited to the U.S. Department of Treasury's Office of Foreign Assets Control ("OFAC"), or which would involve proceeds of any unlawful activity; publishing, distributing or disseminating any unlawful material or information;
- Engage in any fraudulent activity which operates to defraud Blaze, any Blaze User or Users, or any other person; or provide any false, inaccurate, or misleading information to Blaze;
- Engage in any form of unlawful gambling activity which facilitates any lottery; bidding fee auction; sports forecasting or odds making; fantasy sports league with cash prizes; internet gaming; contest; sweepstakes; or games of chance that are not sanctioned by a governmental body or regulatory authority;
- Engage in any harassing, threatening, intimidating, predatory or stalking conduct;
- Use or attempt to use another User's Account;
- Impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity;
- Sell, resell or commercially use any of the Services without explicit, written approval from Blaze;
- Copy, reproduce, distribute, publicly perform or publicly display all or portions of our Services, except as expressly permitted by us or our licensors;
- Modify our Services, remove any proprietary rights notices or markings, or otherwise make any derivative works based upon our Services;
- Use our Services other than for their intended purpose and in any manner that could interfere with, disrupt, negatively affect or inhibit other Users from fully enjoying our Services or that could damage, disable, overburden or impair the functioning of our Services in any manner;
- Use the Services directly or indirectly for any prohibited business purpose, as restricted by Blaze Financial Services Partners, business partners and processing institutions, including, but not limited to, regulated products and services, including marijuana businesses, e.g.: sale of a legal substance that provides the same effect as an illegal drug (e.g., salvia, kratom); sale of narcotics, controlled substances, and any equipment designed for making or using drugs, such as bongs, vaporizers, and hookahs; marijuana dispensaries and related businesses; sale of tobacco, e-cigarettes, and e-liquid; online prescription or pharmaceutical services; age restricted goods or services; weapons and munitions; gunpowder and other explosives; fireworks and related goods; toxic, flammable, and radioactive materials; products and services with varying legal status on a state-by-state basis, regulated financial sub-services, e.g.: securities brokers; mortgage consulting or debt reduction services; credit counseling or repair; real estate opportunities; investment schemes; check cashing, bail bonds; and collections agencies, the provision of adult content and services, e.g.: sale of pornography and other obscene materials (including literature, imagery and other media); sites offering any sexually-related services such as prostitution, escorts, pay-per view, adult live chat features, and the provision of unfair, deceptive, and or predatory products and practices;
- Reverse engineer any aspect of our Services or do anything that might discover source code or bypass or circumvent measures employed to prevent or limit access to any part of our Services;
- Attempt to circumvent any content-filtering techniques we employ or attempt to access any feature or area of our Services that you are not authorized to access;
- Use any data mining, robots or similar data gathering or extraction methods designed to scrape or extract data from our Services;
- Develop or use any applications that interact with our Services or any individual element of the Blaze technology without our prior written consent;
- Bypass or ignore instructions contained in our robots.txt file; or
- Use our Services for any illegal or unauthorized purpose, or engage in, encourage or promote any activity that violates these Terms, including by not limited to unlawful internet gambling.
Enforcement of this Section is solely at Blaze's discretion, and failure to enforce this section in some instances does not constitute a waiver of our right to enforce it in other instances. In addition, this Section does not create any private right of action on the part of any third party or any reasonable expectation that the Services will not contain any conduct that is prohibited by such rules.
Security
You are responsible for the safety and security of your devices. Blaze is not liable for any damage or interruptions caused by any malware, viruses, or other malicious code that may affect your computer or other equipment, or any phishing, spoofing or other attack. We advise you to update your device regularly. You must notify us immediately by emailing support@blaze.money, if you become aware of or suspect: (i) any loss, theft or compromise of your biometrics, your device, security credentials or any device paired to your Account or (ii) any unauthorized use of your Account.
User Protection
You should only use the Services with, including to send payment or monetary transfers to, individuals you know and trust. We do not recommend using the Service to transact with people you don't know.
In General
This Service does not provide you deposit or investment account protection, under FDIC or SIPC, and your use of the Services will not safeguard any asset that you may hold in connection with use of the Services. Furthermore, any third party, internet service-based platform is subject to risk and you should not treat Blaze Services and related service platforms as secure.
Transaction Review
As part of ongoing legal and regulatory obligations, Blaze and/or our Financial Services Partners may review transactions and take additional actions, including stopping transactions, reversing transactions or reporting transactions to third parties.
When a transaction is identified as a potentially high-risk transaction or activity, such as fraud or financial crime, the transaction may be reviewed more closely. When this happens, our Financial Services Partners may place a hold on the transaction and the other party may be notified. If the transaction is cleared, the other party may also be notified. If a transaction is not cleared, the transaction may be declined or canceled. Your money may or may not be returned to you, depending on the actions we or our Financial Services Partners are legally required to take. Regardless of whether a transaction is cleared, if you suspect any suspicious behavior, unauthorized access, or fraud, please contact Blaze immediately at support@blaze.money because our clearance does not guarantee that a transaction is not fraudulent or at high-risk of fraud or that any transaction that is cleared or processes by the Service is legal or in compliance with applicable laws, rules or regulations.
Ownership; Limited License
The Services, including the text, graphics, images, photographs, videos, illustrations and other content contained therein, as well as each individual element of the Blaze technology are owned by Blaze, its subsidiaries and affiliates, or our licensors and are protected under both United States and foreign laws. Except as explicitly stated in these Terms for Blaze, all rights in and to the Services are reserved by us or our licensors. Subject to your compliance with these Terms, you are hereby granted a limited, nonexclusive, nontransferable, non-sublicensable, revocable license to access and use our Services for your non-commercial, internal business purposes. Any use of the Services other than as specifically authorized herein, without our prior written permission, is strictly prohibited, will terminate the license granted herein and violate our intellectual property rights.
Trademarks
The Blaze logo, and our other logos, product or service names, slogans and the look and feel of the Services are registered trademarks or unregistered trademarks of Blaze, and may not be copied, imitated or used, in whole or in part, without our prior written permission by any person or entity other than Blaze. All other trademarks, registered trademarks, product names and company names or logos mentioned on the Services are the property of their respective owners. Reference to any products, Services, processes or other information by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation by us.
Feedback
We value and appreciate your feedback about our Service. Your insights and suggestions help us improve and grow. By sharing your thoughts and comments with us ("feedback"), you agree to give Blaze the freedom to use this feedback, without compensation of any kind, in any way that we deem necessary or reasonable. This includes enhancing our current Services and developing new products. Please note that while we may incorporate your feedback into our improvements, we are not obligated to give you credit for your contributions.
Third-party content, products, and services
We may make third-party information and other content available on or through the Services (the "Third-Party Content") as a service to those interested in this information, and we may provide information regarding or access to third-party products or services available on or through the Services ("Third-Party Products and Services"). Blaze does not control, endorse or adopt any Third-Party Content or Third-Party Products and Services, and makes no representation or warranties of any kind regarding the Third-Party Content, including without limitation regarding its accuracy or completeness. Your business dealings or correspondence with such third parties, and any terms, conditions, warranties or representations associated therewith, are solely between you and such third party. You acknowledge and agree that Blaze is not responsible or liable in any manner for any Third-Party Content or any Third-Party Products and Services or for claims, injury or damages of any kind that may arise from such Third-Party Content or Third-Party Products and Services, and undertakes no responsibility to update or review any Third-Party Content or Third-Party Products and Services. Users use of such Third-Party Content and Third-Party Products and Services contained therein at their own risk.
Financial Services Partners
Blaze partners with certain service providers in order to provide Services to you ("Financial Services Partners"). Certain Services were offered through Astra, Inc., Bridge Ventures, Inc., Dlocal Group Limited, Shift4 Payments, LLC, and Approvely, Inc. None of our Financial Services Partners are a bank or affiliated with Blaze. We retain the right to add and modify Financial Services Partners with whom we partner to provide such services at any time.
By creating a User Account with Blaze and initiating financial transactions, you agreed to our Terms of Services, the Blaze Financial Privacy Statement, and the Financial Services Partner's Privacy Policies listed in Blaze's Privacy Policy under "Information Sharing." By creating a User Account with us, you acknowledge that our Financial Services Partners may share your information as necessary with their affiliates, Partner Financial Institutions and other service providers in connection with providing their respective services. It is your responsibility to make sure that the information you provide to Blaze is accurate and complete. It is your responsibility to read and understand both our and our Financial Services Partner's Terms and Privacy Policies as they contains terms and conditions relating to your Account including but not limited to your rights, limitations, reversal and other liabilities, limitation of liability and binding arbitration provisions. Blaze will provide you with all access to all transaction notifications and balances at the Financial Services Partners, in addition to providing customer support relating to your User Account.
- We use Astra, Inc. to process ACH transactions. By using our App in any way you consent to Astra's Terms;
- We use Bridge Ventures, Inc. for stablecoin orchestration. By using our App in any way you consent to Bridge's Terms;
- We use Dlocal Group Limited to process SPEI and card transactions. By using our App in any way you consent to Dlocal's Terms;
- We use Shift4 Payments, LLC to process card transactions. By using our App in any way you consent to Shift4's Terms;
- We use Approvely, Inc to process card transactions. By using our App in any way you consent to Approvely's Terms;
- We use Evervault services to secure sensitive data. By using our App in any way you consent to Evervault Terms.
- We use Plaid Inc. services to connect Blaze to your bank account. By using our App in any way you consent to Plaid Terms.
- We use Web3auth services through Metallicus, Inc. for authentication services. By using our App in any way you consent to Webauth's Terms.
Indemnification
To the fullest extent permitted by applicable law, you will indemnify, defend and hold harmless Blaze, our subsidiaries and affiliates, and each of our respective officers, directors, agents, partners and employees (individually and collectively, the "Blaze Parties") from and against any losses, liabilities, claims, demands, damages, expenses or costs ("Claims") arising out of or related to (a) your access to or use of the Services or any Blaze technology; (b) use or non-use of your Feedback; (c) your violation of these Terms; (d) your violation, misappropriation or infringement of any rights of another (including intellectual property rights or privacy rights); (e) all transactions initiated under your Account; and (f) your conduct in connection with the Services or any specific Blaze technology.
You agree to promptly notify the Blaze Parties of any third-party Claims, cooperate with the Blaze Parties in defending such Claims and pay all fees, costs (including, but not limited to, attorneys' fees) and expenses associated with defending such Claims. You also agree that the Blaze Parties will have control of the defense or settlement, at Blaze's sole option, of any third-party Claims. This indemnity is in addition to, and not in lieu of, any other indemnities set forth in a written agreement between you and Blaze or the other Blaze Parties.
Disclaimers
To the fullest extent permitted by applicable law, your use of our Services including any specific Blaze technology is at your sole risk. Except as otherwise provided in a writing by us, our Services and any content therein, are provided "as is" and "as available" without representations or warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. In addition, Blaze does not represent or warrant that our Services are accurate, complete, reliable, current or error-free. While Blaze attempts to make your use of our Services and any content therein safe, we cannot and do not represent or warrant that our Services or servers are free of viruses or other harmful components. You assume the entire risk as to the quality and performance of the Services.
Limitation of Liability
Unless otherwise explicitly stated and without prejudice to applicable law, Users shall have no right to claim damages against Blaze (or any natural or legal person acting on its behalf). Users further agree that the limitations set forth in these Terms are valid to the maximum extent allowed under applicable law and certain limitations may not be enforceable in certain states.
This does not apply to damages to life, health or physical integrity, damages resulting from the breach of an essential contractual obligation such as any obligation strictly necessary to achieve the purpose of the contract, and/or damages resulting from intent or gross negligence, as long as this Website has been appropriately and correctly used by the User.
Unless damages have been caused by way of intent or gross negligence, or they affect life, health or physical integrity, Blaze shall only be liable to the extent of typical and foreseeable damages at the moment the contract was entered into.
If you are a consumer who resides in California, you hereby disclaim your rights against limitations of liability under California Civil Code § 1668, which provides: "All contracts which have for their object, directly or indirectly, to exempt any one from responsibility for his own fraud, or willful injury to the person or property of another, or violation of law, whether willful or negligent, are against the policy of the law."
Release
To the fullest extent permitted by applicable law, you release Blaze and other Blaze Parties from responsibility, liability, claims, demands and/or damages (special, actual and consequential) of every kind and nature, known and unknown (including, but not limited to, claims of negligence), arising out of or related to disputes between Users and the acts or omissions of third parties, unless and to the extent prohibited by law. You further agree that you agree that the releases set forth in these Terms are valid to the maximum extent allowed under applicable law and certain limitations may not be enforceable in certain states. If you are a consumer who resides in California, you hereby waive your rights under California Civil Code § 1542, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."
Transfer and Processing Data
In order for us to provide our Services, you agree that we may process, transfer and store information about you in the United States and other countries, where you may not have the same rights and protections as you do under local law. Please see our Privacy Policy for more information about your rights and protections.
Dispute Resolution; Binding Arbitration
In all cases, if there is a dispute, claim or controversy arising out of, or relating to, or in connection with this Agreement, it will be settled under the Rules of Arbitration of the International Chamber of Commerce by one (1) arbitrator in accordance with such Rules. If you are resident in the United States, please note with the exception of certain kinds of disputes (such as complaints, dispute resolution and arbitration), you agree that disputes arising under these Terms will be resolved by binding, individual arbitration and will not be brought as a className arbitration, className action or any other type of representative proceeding. BY ACCEPTING THESE TERMS, YOU AND BLAZE ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY className ACTION OR REPRESENTATIVE PROCEEDING. You agree to give up your right to go to court to assert or defend your rights under this contract (except for matters that may be taken to small claims court). Your rights will be determined by a neutral arbitrator and not a judge or jury. The seat of the arbitration shall be in the state of Florida, and the arbitration shall be conducted in the English language. The arbitration award shall be final and binding on the Parties, and the Parties hereby waive the right to appeal to any court for amendment to or modification of the arbitration award. Judgment upon the award may be entered by any court having jurisdiction thereof or having jurisdiction over the relevant Party or its assets. The obligations in this paragraph shall survive termination of the Agreement.
Governing Law and Venue
These Terms are governed by the laws of the State of Delaware without regard to conflict of law principles. You are responsible for complying with all applicable laws and regulations that apply to these terms and your use of the service. You and Blaze submit to the personal and exclusive jurisdiction of the state courts and federal courts located in Delaware for resolution of any lawsuit or court proceeding permitted under these Terms.
European Residents. These Terms and any non-contractual obligations arising from or in connection with the Terms are governed by and construed in accordance with the laws of the Poland, without giving effect to any principles of conflicts of law. This does not affect any rights you, if you qualify as a consumer, may have under the law of your own country to have a dispute heard under the laws of your own country.
Your Compliance with Applicable Law. You must comply with all applicable laws, regulations, licensing requirements and third party rights (including, without limitation, data privacy laws and anti-money laundering and countering the financing of terrorism laws) in your use of our Services.
Modifying and Terminating our Services
We reserve the right to modify our Services or to suspend or stop providing all or portions of our Services at any time, while using commercially reasonable efforts to notify Users of such modifications, suspensions or terminations. You also have the right to stop using our Services at any time, but these Terms will still apply to you and Blaze until the Account is terminated in accordance with these Terms. We are not responsible for any loss or harm related to your inability to access or use our Services.
Severability
If any provision or part of a provision of these Terms is unlawful, void or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.
Export Restrictions
The technology provided by Blaze, along with all associated information and technology accessed or downloaded through our Services (collectively referred to as the "Software or Technical Data"), may be subject to U.S. export controls, including the Export Administration Act (50 U.S.C. Appx. §§ 2401 et seq.) and the Export Administration Regulations ("EAR", 50 C.F.R. Parts 730-774), as well as export or import regulations in other countries. You are responsible for adhering to all relevant trade regulations and laws, both domestic and international. Except as permitted by law, you agree and guarantee not to export or re-export the Software or Technical Data to any country, person, entity, or end-user that is subject to U.S. export controls, including but not limited to individuals or entities listed on the U.S. Department of Commerce Bureau of Industry and Security's Denied Persons List and the U.S. Department of Treasury's Specially Designated Nationals List. You also represent and warrant that no U.S. federal agency has suspended, revoked, or denied your export privileges.
Communications
By signing up for Blaze and providing us with your contact information, such as your email and phone number, you confirm that you are the current subscriber or owner of that email and phone number. Additionally, you consent to being contacted by Blaze and its authorized Third Party Service Providers via email, phone call, or text message. We may reach out to you for various reasons, including but not limited to, updates to our Terms of Service, Account notifications, feedback requests, and support purposes. Message frequency may vary, and standard charges for telephone minutes and text messages may apply. Neither Blaze nor your phone carriers are responsible for delayed or undelivered messages.
You can opt out of receiving autodialed or pre-recorded calls or texts to your mobile number by contacting our customer support team at support@blaze.money or by replying STOP to any message.
Miscellaneous
General Terms
These Terms, along with our Privacy Policy and any other agreements explicitly referenced within or linked from them, represent the complete and exclusive agreement between you and Blaze concerning your use of our Services. You are prohibited from assigning or transferring these Terms or any rights under them, whether in full or in part, by operation of law or otherwise, without our prior written approval. Our failure to enforce any provision at any time shall not waive our right to enforce it later, nor shall a waiver of any breach or default under these Terms constitute a waiver of any subsequent breach or default. Section headers within these Terms are provided for convenience and do not affect the interpretation of any provision. Throughout these Terms, the term "including" is to be understood as "including but not limited to." Should any portion of these Terms be deemed invalid or unenforceable, that portion will be enforced to the fullest extent possible, and the remaining portions will continue to be in full effect.
Notice Regarding Apple
This section applies specifically if you are using our App on an iOS device. You acknowledge that these Terms are solely between you and Blaze . Apple Inc. ("Apple") is not a party to any of these Terms and that Apple bears no responsibility for the Service or its content. Apple is not obligated to provide any maintenance or support services for the Service. Should the Service fail to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App, if applicable. Beyond this, to the extent permitted by law, Apple has no additional warranty obligations regarding the Service. Apple is not liable for addressing any claims by you or third parties related to the Service or your use of it, including but not limited to: (1) product liability claims; (2) claims that the Service fails to comply with legal or regulatory standards; or (3) claims arising from consumer protection laws. Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the Service or your use of it infringes on intellectual property rights. You agree to adhere to any applicable third-party terms when using the Service. Apple and its subsidiaries are considered third-party beneficiaries of these Terms and, upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary. You affirm and warrant that: (a) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist-supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
